THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.310 of 2017 ORDER:

This civil revision petition is filed under Section 22 of A.P. Buildings (Lease, Rent & Eviction) Control Act, 1960, challenging the order dated 29.4.2016 in R.A. No.80 of 2016 on the file of the Court of Additional Chief Judge, City Small Causes court, Hyderabad.

Heard the learned counsel for the petitioner and learned counsel for the respondent.

A perusal of the record reveals that the respondent herein filed R.C. No.4 of 2015 on the file of Additional Rent Controller, Secunderabad against the petitioner herein for eviction on the ground of willful default in payment of rent. The learned Rent Controller allowed the R.C., on 21.12.2015 directing the petitioner to vacate the petition schedule property within sixty days. Feeling aggrieved by the orders of the Rent Controller, the petitioner filed the R.A., and the same was also dismissed on 29.4.2016. Hence, the present revision.

Pending revision, the petitioner filed an affidavit by giving an undertaking that he will vacate the premises on or before 31.5.2017 besides paying the arrears of rent within one month from today and continue to pay future rent up to 31.5.2017.

In view of the above undertaking, the petitioner is directed to vacate the premises on or before 31.5.2017, pay the arrears of rent on or before 06.3.2017 and continue to pay future rent up to May, 2017, failing which the respondent is at liberty to take appropriate action against the petitioner in accordance with law.

With the above direction, the civil revision petition is dismissed. Miscellaneous petitions, if any pending in this revision petition shall stand closed.
