THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed feeling aggrieved by proceedings in File No.1504/TPS/NZ/GHMC/2015, dt.29.10.2015, issued by respondent No.3, calling upon the petitioner to submit revised layout plan within fifteen days from the date of receipt of the said communication. On 11.12.2015 this Court has passed the following order. "The grievance of the petitioner, as projected in this Writ Petition and argued by the learned Counsel representing him, is that even before the Mandal Revenue Officer/Tahsildar deputed the land surveyor to identify the actual ground position of the road and demarcate the actual layout as requested by the Deputy Commissioner, Cuircle-17 (NZ), Malkajgiri, GHMC, Hyderabad, vide his letter, dated 05.05.2015, respondent No.3 has directed the petitioner to submit the proposals for revised layout.

This Court, therefore, would like to know whether the Deputy Commissioner's request was complied with by the Mandal Revenue Officer/Tahsildar and a survey report reflecting the ground position has been submitted by the surveyor. The Deputy Commissioner, Circle -17, North Zone, Malkajgiri, GHMC, Hyderabad, is, therefore, directed to be personally present along with records on 16-12-2015.

Today, the Deputy Commissioner, Circle No.17, North Zone, Malkajgiri, Greater Hyderabad Municipal Corporation (GHMC), Hyderabad, is personally present and submitted that the Mandal Revenue Officer/Tahsildar has not demarcated the position of the road and actual layout as requested by his predecessor in office, vide his letter dt.05.05.2015. He has further admitted that the petitioner will not be in a position to file revised layout plan unless he is aware of the actual road position after demarcation. He has fairly agreed to pursue with the Mandal Revenue Officer (MRO)/Tahsildar concerned and issue a fresh notice to the petitioner, along with the report that may be submitted by the MRO/Tahsildar after demarcation, for submitting

application for revised layout.

In view of the above submissions of the Deputy Commissioner Circle No.17, North Zone, Malkajgiri, GHMC, Hyderabad, which is placed on record, the writ petition is disposed of.
