THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7515 of 2017 ORDER:

This Writ Petition was filed challenging the registration of FIR No.717 of 2016 dated 10.12.2016 under Sections 447 and 427 IPC.

Learned Counsel for the petitioners submits that there were disputes between the petitioners and the fourth respondent, which are pending in the competent civil Court. However, in order to cause harassment to the petitioners, the fourth respondent lodged a complaint against the petitioners, which was registered as Crime No.717 of 2016, as stated above. Learned Counsel for the petitioners further submits that one Afsar Shareef was shown as accused No.6, though he is a resident of Australia and never visited India in December, 2016, and the motive behind the complaint could be seen from the said incident.

Since the crime is registered by the Police, this Court cannot interfere with the investigation process. However, it is needless to observe that respondent No.3 shall investigate the matter only in accordance with law keeping in view the provisions of the Code of Criminal Procedure and also the fact of Afsar Shareef not visiting India during the month of December, 2016. The third respondent shall not harass the petitioners during the process of investigation.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 03.03.2017 vs
