C.Mallikarjuna v. State Of Ap.,
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.6 6 8 of 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.148 of 2016 on the file of Thondangi Police Station, East Godavari District. The offence alleged is under Section 409 IPC.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
Learned counsel for the petitioner submits that earlier the petitioner filed Crl.P. No.12245 of 2017 before this Court, seeking anticipatory bail and the same was dismissed on the ground that the investigation has to be done in order to understand the role of this petitioner. However, the public prosecutor submits that even according to the confession made by accused, he is involved in various offences and the offence is extended to East Godavari District. The role of this accused is evident from the report given by the de facto complainant. 4.
The allegation against this petitioner is that he changed the thumb impression in the bio-metric system and drawn the essential commodities by making fake ration cards. 5.
Hence, this Court opines that it is not a fit case for granting anticipatory bail to the petitioner. 6.
With the above observation, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for
regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, on merits expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
