THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.V.M.P.No.2163 of 2017 In W.P.No.6139 of 2017 And WRIT PETITION No.6139 of 2017 ORDER:

Petitioners have filed this Writ Petition challenging the action of 4th respondent in trying to dispossess them from Plot Nos.110 and 74 allotted to them in Sy.No.318-2 of Pamidi Village and Mandal, Anantapur District for use as house sites without following due process of law.

On 22-02-2017, this Court directed status quo as on that day to be maintained over the subject land.

Counter-affidavit is filed by respondent Nos.1 to 4 stating that notices were attempted to be served on petitioners, but they declined to receive and thereafter public notice was issued. 4.

This fact is denied by counsel for petitioners. 5.

However, since copies of the show cause notices are enclosed to the vacate stay petition, petitioners are directed to give explanation to the show cause notice issued by the 4th respondent within four (04) weeks from the date of receipt of copy of the order, and the 4th respondent is then directed to pass a reasoned order in accordance with law and communicate it to the petitioners. Till then the petitioners shall not be dispossessed from the plots allotted to them.

W.V.M.P.No.2163 of 2017 is dismissed.

Consequently, Writ Petition is disposed of with the above directions. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
