HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.2068 of 2018 Order:

In the present case notice before admission was ordered on 25.01.2015 by granting four weeks time for getting instructions. In spite of that, learned Government Pleader was not issued any instructions nor a counter affidavit is filed. In the circumstances, this Court is constrained to dispose of the Writ Petition based on the averments made in the affidavit filed in support of the Writ Petition.

The petitioners state that the first petitioner is a landless poor person and sought assignment of the land in her favour. Considering her request the land of an extent of Ac.1-31 cents, situated in Survey No.76/1B of Kotikalapudi village, Ibrahimpatnam mandal, Krishna District was assigned to her by proceedings of the fourth respondent dated 21.02.1996. She was directed to pay an amount of Rs.655/- with interest at 8% per annum in 15 installments. She states that she paid the said amount. The fourth respondent issued pattadar passbooks and title deeds and she has been in continuous possession of the said land. When she obtained Adangal/Pahani for the year 2014, she noticed that the name of one Rentapalli Kotaiah was shown in pattadar and possessor column. No notice was issued to the first petitioner. She submitted a representation on 06.

09.2015 in the form of 'Mee Intiki Mee Bhoomi' and in spite of the same, when no action was taken she submitted another representation on 22.04.2016. The second petitioner is also claiming the land in an extent of Ac.1-00, situated in RS No.76/1 of the same village. When she obtained copy of Adangal in the year 2014, in the Adangal it was recorded as Vagu (Stream) in respect of the said land and in those circumstances, she also filed a representation on 06.09.2015 followed by another representation on 10.08.2017.

respondent was not taking any steps for correction of entries pursuant to the above representations, the present Writ Petition is filed. Since the fourth respondent did not respond to the notice issued in the present Writ Petition, the fourth respondent is directed to consider the representations filed by the petitioners and pass appropriate orders thereon within a period of two (2) months from the date of receipt of a copy of this order after issuing appropriate notice to the person whose name was mentioned in the revenue records in the place of the petitioners. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
