THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22039 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as fair price shop dealer of shop No.27 of BR Thalavalsa, Padmanabham Mandal, Visakhapatnam District. While so, on 14.09.2014, the Deputy Tahasildar inspected the shop of the petitioner and found some variation and submitted a report. Basing on the said report, the 3rd respondent suspended the authorization of the petitioner temporarily by order dated 04.10.2014 without issuing any notice and without conducting any enquiry. Against the same, the petitioner filed W.P.No.31614 of 2014 before this Court, and on 21.10.2014, this Court while disposing of the said writ petition, directed the 3rd respondent to complete the enquiry and pass final orders within two months. The petitioner also filed an appeal before the 2nd respondent on 25.11.2014 against the suspension order and the same is pending.

While so, the 3rd respondent issued show cause notice to the petitioner on 11.06.2015, and in response to the same, the petitioner submitted an explanation on 15.06.2015. Hence, the present writ petition is filed to direct the 2nd respondent either to conduct enquiry or to dispose of the said appeal filed by the petitioner.

Since the appeal is pending before the 2nd respondent against the order of suspension dated 04.10.2014 passed by the 3rd respondent, this Court is not inclined to interfere with the enquiry at this stage. However, the 3rd respondent is directed to conduct enquiry and

pass final order thereon, within a period of thirty days from the date of receipt of a copy of this order, by duly following the principles of natural justice in the enquiry process.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. _________________________ A.RAMALINGESWARA RAO, J Date: 16.07.2015 siva
