THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.8406 of 2017 ORDER:

This criminal petition is filed by the petitioner-accused No.1, under Sections 437 and 439 Cr.P.C., seeking bail in Crime No.70 of 2017 on the file of the Station House Officer, Mahanandi Police Station, Kurnool District, registered for the offence punishable under Section 366(A) IPC.

The learned counsel for the petitioner submitted that the petitioner was falsely implicated in this case. He further submitted that entire investigation is completed except filing of the charge sheet. Per contra, the learned Additional Public Prosecutor representing the State submitted that the investigation is in progress.

The case of the prosecution is that on 01.07.2017 the petitioner forcibly taken away the daughter of the de facto complainant from the school. Basing on the information given by one Madhu, the de facto complainant, who is the father of the victim lodged the complaint. The petitioner filed Crl.M.P.No.1233 of 2017 on the file of the Court of V Additional District & Sessions Judge, Kurnool at Nandyal, and the same was dismissed on 22.08.2017.

A perusal of the record reveals that the victim girl by name Sunitha is aged about 15 years, who is studying 10th class. The record further reveals that the petitioner forcibly

taken away the victim girl from the school without the consent and knowledge of her parents. The record further reveals that the investigation is in progress. 5.

Taking into consideration the gravity of the offence alleged to have been committed by the petitioner and the stage of investigation, this Court is of the considered view that it is not a fit case to grant bail to the petitioner-A1. 6.
