THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.13965 OF 2016 O R D E R :

Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.

2. Petitioner's grievance is that he is the owner of the subject land; that he intended to sell the said land to some third party; but the 2nd respondent is not receiving the document for the purpose of registration and is insisting for production of 'No Objection Certificate' in respect of the said land from revenue authorities.

3. The Government Pleader for Revenue appearing for respondents states that the 2nd respondent would receive the document presented by the petitioner and if he does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said document.

4. In view of the said submission, the Writ Petition is disposed of directing the 2nd respondent to receive the document presented by the petitioner, without insisting for production of 'No Objection Certificate', and if the 2nd respondent does not wish to register it, he shall pass an order, why he does not wish to register, under Section 71 of the Act within a period of eight (08) weeks from the date of presentation of documents by the petitioner and communicate his decision thereon to the petitioner. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
