HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2418 OF 2019 O R D E R:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is further prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring the inaction of the 3rd respondent in not considering the petitioner's application dated 11.10.2018 for rectification of entries in the Revenue records violating the provision Rule 17 of the Telangana Rights in Land and Pattadar Passbooks Rules 1989 pertaining to Sy.No.448/68, to an extent of Ac.10-00 gts of Laxmipuram Village, Burgampadu Mandal, Bhadradri Kothagudem District, as being illegal and unjust and to grant such other relief or reliefs as this Hon'ble court deems fit and proper in the circumstances of the case."

By way of application dated 11.10.2018 made to various authorities, the petitioner sought rectification of the entries in the revenue records. It may however be noted that as per Section 3(3) of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 (for brevity 'the Act of 1971'), rectification of entries may be sought by any person affected by an entry made in the Record of Rights within one year from the date of the notification published under Section 3(2) of the Act of 1971.

Sri Praveen Kumar Veerjala, learned counsel for the petitioner, would fairly concede that the application was not made by the petitioner within one year from the date of publication of the Record of Rights under Section 3 (2) of the Act of 1971. That being so, the very application made by the petitioner on 11.10.2018 was misconceived.

The Writ Petition is accordingly dismissed on this short ground. This order shall however not preclude the petitioner from

invoking appropriate remedies available to her under law before the competent forum in accordance with the due procedure. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
