THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1777 of 2015 ORDER:
This revision is preferred challenging the judgment dated 19.06.2015 in E.C.Appeal No.30 of 2014 on the file of the Sessions Judge, Krishna, Machilipatnam, wherein and whereby the learned Sessions Judge dismissed the appeal filed by the petitioner by reducing the confiscation of 25% of the seized stock to that of 15% of the seized stock. The learned counsel for the petitioner submits that the petitioner is a licence holder in doing food grains business, and he purchased the stock under valid bills and he has not contravened any of the conditions of licence and also the control order.
Having heard the learned counsel for the petitioner and the learned Public Prosecutor and after perusing the material available on record, this Court is of the considered view that confiscation of 10% of the seized stock would be appropriate. Accordingly, the Criminal Revision Case is disposed of modifying the judgment of the Sessions Judge, Krishna, Machilipatnam, passed in E.C.Appeal No.30 of 2014, dated 19.06.2015, by reducing the confiscation of 15% of the seized stock to 10% of the seized stock.
