This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.3 seeking regular bail in connection with COR.No.80 of 2025 of Prohibition and Excise Police Station, Uppal, Medchal-Malkajgiri District. The offences alleged against the petitioner are under Sections 8(c) r/w.20(b)(ii)(A) & 22 (c) of NDPS Act.

The facts of the case are that on 02.08.2025 at 9:44 P.M., AC Enforcement, Ranga Reddy, along with staff and panchas, conducted a raid at Genius Grammar School, Kothapet, Medchal District, after obtaining permission from the Assistant Prohibition and Excise Superintendent. The two persons on a Honda CB Shine bearing No. TS 08 EU 1956 were stopped. On search of their bike and bag, the officers found two digital weighing machines, 513 grams of dry ganja, and 13.65 grams of MDMA. The accused confessed that they had procured ganja from Dhoolpet and MDMA from Rishab Agarwal @ Sunny for resale at higher price. Both A1 and A2 were arrested, and the contraband, bike, and two mobile phones were seized under the cover of Panchanama. Hence, complaint was registered against the accused for the above offences.

Heard Sri Umesh Singh, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and he is in jail from 30.08.2025 i.e., for more than 155 days. Petitioner has been falsely implicated in this case only basing on his
- 3 - acquaintance with A.1. Further no recovery is made from the possession of the petitioner herein and till now charge sheet is not filed. Hence, prayed this Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail contending that the petitioner herein is a drug peddler and the contraband seized is a huge commercial quantity. Hence, prayed this Court not to grant bail to the petitioner and to dismiss this petition. However, he informed the Court that charge sheet is not yet filed.

Having regard to the submissions made and the material placed on record, it is seen that petitioner is in jail for more than 155 days and till today charge sheet is not filed. Considering the period of incarceration of petitioner in jail and the facts and circumstances, this Court deems it fit to grant bail to the petitioner/A.3 subject to the following conditions: i. The petitioner/A.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of learned Judicial First Class Magistrate, Medchal-Malkajgiri District at L.B.Nagar.
- 4 - ii. The petitioner/A.3 shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii. The petitioner/A.3 shall abide by the other conditions stipulated in Section 483(2) of the BNSS. 7.
Accordingly, the Criminal Petition is allowed.
Miscellaneous petitions, if any, pending shall stand closed.
