HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.487 of 2015 ORDER:

Heard both the counsel and pursued the impugned docket order dated 20.3.2015 in D.V.C.No. 27 of 2015, which reads as follows: "Petitioner present. Respondent No. 1 present, other respondents absent. Crl.M.P. - of 2015 pending. call on 27.3.2015."

Learned counsel for petitioner would submit that as per the order dated 19.2.2014 in Crl.M.P.No. 5730/2013, learned II Metropolitan Magistrate, Cyberabad, L.B.Nagar, permitted the first respondent to represent the other respondents and in that view of the matter, after transfer of the DVC from the said Court to XXI Metropolitan Magistrate, Cyberabad at Medchal, the transferee Court by the impugned docket order directing all the respondents to appear on 27.3.2015 is not justified. As can be seen from the impugned docket order, it would appear that the earlier order dated 19.2.2014 in Crl.M.P.No. 5730 of 2013 was not brought to the notice of the transferee Court.

UDPR, J CRL.R.C.NO. 487 OF 2015 Be that as it may, the respondents in DVC No. 27 of 2015 are directed to appear before the XXI Metropolitan Magistrate, Cyberabad, Medchal, on the next date of hearing and bring to the notice of the said Court about the order dated 19.2.2014 in Crl.M.P(sr) No. 5730 of 2013 and seek for exemption of appearance of other respondents who were being represented by respondent No. 1 and the said Court shall consider the same and pass appropriate orders.

Accordingly, the Criminal Revision Case is disposed of. As a sequel there to, miscellaneous applications, pending if any, shall stand closed.
