HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Crl.P.M.P.Nos.11109 & 11110 of 2015 IN/AND CRIMINAL PETITION No.3273 of 2013 COMMON ORDER :
This criminal petition is filed by the petitioners/A.1 and A.2 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.702 of 2012 on the file of the II Additional Chief Metropolitan Magistrate, Vijayawada, for the offences punishable under Sections 498-A and 323 IPC.
2. Pending the criminal petition, both parties filed Crl.M.P.Nos.11109 and 11110 of 2015 along with affidavit of the 2nd respondent-de facto complainant and a joint memo stating that they amicably settled the matter to purchase peace and, therefore, to accord permission to compound the above offences.
3. Having heard the parties, permission is thereby accorded as the parties stated that they have amicably settled the matter to purchase peace. Accordingly, the offences are compounded in terms of their compromise at the instance of the de facto complainant since present with the petitioners/A.1 and A.2.
4. Accordingly, Crl.M.P.Nos.11109 and 11110 of 2015 are allowed. Consequently, the criminal petition is allowed and all the proceedings relating to C.C.No.702 of 2012 on the file of the II Additional Chief Metropolitan Magistrate, Vijayawada, are quashed against the petitioners/A.1 and A.2. The bail bonds of the petitioners/A.1 and A.2, if any, shall stand cancelled.
5. Miscellaneous petitions pending, if any, shall stand closed. ____________________________
