HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No: 10640 OF 2015 ORDER:

The petitioners who are accused Nos.4, 5 & 7 in Crime No.124 of 2015 of Pentapadu Police Station, West Godavari District, registered for the offences punishable under Sections 302, 342 read with Section 34 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

In view of the fact that the crime was registered for the offence punishable under Section 302 I.P.C. also, there is necessity of custodial interrogation of petitioners - accused Nos.4, 5 & 7. Hence, this Court is not inclined to grant anticipatory bail to petitioners. It is submitted by the learned counsel for petitioners that some of the accused in the above crime were already arrested and released on bail.

This Court is of the view that it is left open for petitioners to surrender before the concerned Court and to get bail in accordance with law.
