THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39415 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering the FIR No.169 of 2016 against the petitioners, as illegal and arbitrary. The case of the petitioners is that the 4th respondent has lodged the present complaint against the petitioners alleging that the marriage between the 4th respondent and the 1st petitioner was performed on 27.04.2016 and that after marriage, the 1st petitioner along with his family members are harassing the 4th respondent physically and mentally and ill-treating her continuously for the agreed amount during lagnapatrika. The main grievance of the petitioners is that on the alleged complaint of the 4th respondent, the 3rd respondent registered the same as FIR No.169 of 2016 on 03.10.
2016 for the offences punishable under Sections 498-A, 506, 420, 406 read with 34 IPC and Sections 3, 4 & 6 of the Dowry Prohibition Act and that the petitioners are now apprehending that they may be arrested by respondents 2 & 3 in the above said crime. Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.169 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
