HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.747 of 2019 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to reduce the surety amount in respect of condition No.2 in the order, dated 12.11.2018 in Crl.M.P.No.1344 of 2018 in Cr.No.641 of 2017 passed by the Judl. Magistrate of I Class, Shadnagar.

Vide impugned order, the trial Court while imposing other conditions, directed the petitioner to execute undertaking bond of Rs.5,00,000/- and with bank guarantee for release of the vehicle i.e.,Xylo Mahindra Motor vehicle bearing No. TS08UB4537.

Taking into consideration the nature of offence and having regard to the facts and circumstances of the case, I deem it appropriate to modify the said order. 4.

Accordingly, the Criminal Petition is disposed of and the order, dated 12.11.2018 in Crl.M.P.No.1344 of 2018 in Cr.No.641 of 2017 on the file of the Judl. Magistrate of I Class, Shadnagar, is modified by directing the petitioner to execute undertaking bond of Rs.4,00,000/- and with bank guarantee. However, the other conditions imposed by the trial Court shall remain

unchanged. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
