HON'BLE SRI JUSTICE SURESH KUMAR KAIT W.P. Nos. 39533, 39508, 39622, 40353, 40385, 40395, 40397, 40427, 40406 and 43019 of 2015 COMMON ORDER:- Inasmuch as the question of fact and law involved in these writ petitions are one and the same, these matters are taken up together for disposal by this common order. The main grievance of the writ petitioners is that the respondents are not paying determined amount of compensation payable to them in respect of their acquired lands even after long lapse of 15 years. The petitioners also seek a direction to the respondents to deposit the compensation as determined in the respective O.P.Nos.4, 3, 41, 10, 2, 15, 44, 8, 7 and 9 of 2005 on the file of the Court of Senior Civil Judge, Miryalaguda.

It is not in dispute that the lands of the petitioners were acquired by the Government under the provisions of Land Acquisition Act (for brevity " the Act" ) by issuing Notification dated 15.02.2000 under Section 4(1) of the Act and award was passed on 19.09.2000, however till date the petitioners have not received compensation amount.

The learned counsel for the petitioners has submitted that in W.P.Nos.20797 and 20826 of 2016, similar issue was raised, and acquisition was made under the same Notification, and therefore, this Court, vide common order dated

SKK,J WP_39533, 39508, 39622, 40353, 40385, 40395, 40397, 40427, 40406 & 43019_2015 04.08.2016, directed the respondents therein to deposit the total compensation amount within a period of four weeks from the date of that order, failing which, the petitioners therein shall be entitled to additional interest at 9% per annum on delayed payment. It was further directed that all the respondents shall sit together and sort out and clear their respective file/ issues within no time so that they will not pass the buck and claim that one file is cleared by one respondent and the other file is not cleared.

The learned counsel for the petitioners has further submitted that same direction may be given to the respondents in the present batch of cases also. The learned Government Pleader for Land Acquisition appearing for respondent Nos.3, 6 and 7 does not dispute the statement made by the learned counsel for the petitioners and submits that similar order may be passed in these writ petitions.

Hence, the respondents are hereby directed to pay the total compensation amount in favour of the petitioners within a period of four weeks from today, failing which, the petitioners shall be entitled to additional interest at the rate of 9% per annum on delayed payment.

Accordingly, these writ petitions are allowed. No order as to costs.
