THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1998 of 2018 O R D E R:

The grievance of the petitioner is that though there is no suspension or cancellation of the authorization granted in his favour in respect of Fair Price Shop No.37, situated at Kotananduru Village and Mandal, East Godavari District, the respondent authorities are not allowing him to distribute the scheduled commodities.

Learned Government Pleader for Civil Supplies placed before this Court a copy of the show cause notice, dated 18.01.2018, said to have been issued to the petitioner asking him to submit explanation with regard to the stock variation. Learned counsel for the petitioner submits that the petitioner has not received the aforesaid notice as on date. As the fair price shop authorization granted in favour of the petitioner is neither suspended nor cancelled, there can be no impediment for the respondent authorities to supply scheduled commodities for distribution.

In those circumstances, the respondents shall complete the enquiry after considering the explanation that may be submitted by the petitioner, expeditiously. Till final orders are passed, the

respondents shall allow the petitioner to operate his fair price shop.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:25.01.2018 kdl
