Heard the learned counsel for the petitioner. The petitioner claims that she was an elected sarpanch of Nuzellapalli Grampanchayat in the year 2014. It is her case that a Grama Sabha was conducted on 05.05.2015 and discussed about the works of de-silting of drinking water tank, de-silting of tank situated at SC colony, de-silting of Lingareddy Kunta and de-silting of Yerramasu Cheruvu. The proposal for de-silting of Lingareddy Kunta was stated to have been rejected by 40 members out of 50 who attended the Grama Sabha.
The second respondent approved the works, vide proceedings dated 26.05.2015 and 30.05.2015. It is her further case that the works are being supervised by a committee constituted by the Grama Sabha. The fourth respondent was allowed to do the work of de-silting of Lingareddy Kunta. She submitted a complaint to the second respondent against the respondents 3 & 4 in respect of the said work and when no action was taken against them by the second respondent, the present writ petition is filed. The intended work of de-silting is for strengthening of the bunds and is for the public benefit. The work is being taken up under Neeru Chettu programme initiated by the Government. The administrative approval was granted by the Collector on 26.05.2015 in respect of 46 works including the work that is being opposed by the petitioner in the instant case. The Government issued G.O.Ms.No.40, Water Resources (CAD.1) Department, dated 28.04.2015 for conducting awareness camp from 02.05.2015 to 11.05.2015 and guidelines were issued.
The petitioner could not show how the public is adversely affected by the Neeru Chettu programme initiated by the Government. The alleged complaint against the respondents 3 & 4 has no statutory
base and hence, the writ petition is not maintainable and is accordingly dismissed. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed. No order as to costs. ____________________________ A. RAMALINGESWARA RAO, J Date: 22.07.2015 Isn
