HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 20674 of 2016 ORDER:

Heard learned counsel for the petitioner and Government Pleader for General Administration. With the consent of both parties, the writ petition is being taken for disposal at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not responding the representation of the petitioner for releasing the balance ex-gratia amount pursuant to the letter of the second respondent in Rc.No.C1/1366/2011, dated 05.09.2012 and 06.08.2014, as illegal, arbitrary and violative of principles of natural justice; and consequently direct the respondents to release an amount of Rs.3,80,000/- with interest forthwith. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation for payment of balance ex-gratia at the earliest.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the respondents to consider the representation made by the petitioner for payment of balance ex-gratia, in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of the order. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
