This petition is filed by the petitioner to withdraw O.S.No.28 of 2004 from the file of Senior Civil Judge, Sathupally, Khammam District and transfer the same to any competent Court at Hyderabad or Ranga Reddy District. Learned counsel for the respondent states that suit which sought to be transferred itself is dismissed. As such, the question of transfer of said suit does not arise and at page No.10 of the material papers, a copy of the decree is filed to show that the suit is dismissed.

In view of the same, the question of transfer of O.S.No.28 of 2004 from the file of Senior Civil Judge, Sathupally, Khammam District does not arise and accordingly, Transfer CMP is dismissed.
