THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17076 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of respondent authorities in initiating the action against the unauthorized construction being carrying by the 5th and 6th respondents at the Plot No: 1 and 10 admeasuring 267 Sq.yards each, MCH bearing No:2-22-179/2 and 2-22-182/2 against the Building Rules 2012 and sanctioned plans and encroaching public road instead of leaving road effected area as per their sanction plan as illegal, arbitrary and unconstitutional and also in violation of Art.21 and 300-A of the Constitution of India and consequently direct the respondents 2 to 4 to ensure the construction shall be made in accordance with the sanction plans and Building Rules, otherwise to take all steps not to allow the unauthorized construction by 5th and 6th respondents."

The main grievance of the petitioner herein is that respondent Nos.5 and 6 are making unauthorized construction against the Building Rules and the sanctioned plans and encroaching the public road instead of leaving road affected area and without leaving any set backs.

Heard and perused the material available on record. 4.

Learned Standing Counsel appearing for the Greater Hyderabad Municipal Corporation submitted that if the

construction made by respondent Nos.5 and 6 is illegal in nature or is made without obtaining permission from the Corporation or if there is any deviation to the sanctioned plans, the Corporation will take appropriate action in accordance with law. 5.

Recording the submission of the learned Standing Counsel, the Writ Petition is disposed of. There shall be no order as to costs. 6.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
