THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY W.P. No.680 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) This Writ Petition is filed to stay all proceedings, under Section 13(4) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, initiated by the respondent - Bank, pending disposal of S.A.No.296 of 2014 on the file of the Debt Recovery Tribunal (DRT), Visakhapatnam.

The petitioner's grievance, in short, is that there is no Presiding Officer at the DRT, Visakhapatnam; and the Presiding Officer, DRT, Hyderabad, has been given full-additional charge of the said post. As the Chairman, DRT, Hyderabad was on leave in 2015, this Court granted interim stay till 19.01.2015 which was extended thereafter by a further period of four weeks. As the DRT, Hyderabad is now given full-additional charge of all matters pending before the DRT, Visakhapatnam, we see no reason to entertain this Writ Petition as the petitioner can as well approach the DRT, Hyderabad for the relief sought for in this Writ Petition.

Sri Ch.Srinivas Raju, Learned Counsel for the petitioner, requests some time to enable the petitioner to file an application before the DRT, Hyderabad for grant of the relief sought for in S.A.No.296 of 2014. Interim order granted earlier shall remain in force till 02.03.2015. In case no orders are passed by the DRT, Hyderabad before then, it is open to the respondent-Bank to take action, after 02.03.2015, in accordance with law.

The Writ Petition stands disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
