THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13614 of 2015 ORDER:

Questioning the action of respondents 3 and 4 in trying to dispossess the petitioners from the lands in their occupation, during pendency of revision before the 2nd respondent-Joint Collector, this writ petition is filed.

The petitioners are in possession and enjoyment of different extents of lands, admeasuring a total of Ac.8-90 cents, in Survey Nos.238/1, 2 & 9 of Pernamitta village, Santanuthalapadu mandal, Prakasam district, having purchased the same through different registered sale deeds. While so, the 4th respondent initiated proceedings dated 15.02.2013, under the A.P. Assigned Lands (Prohibition of Transfers) Act, seeking to evict the petitioners. Questioning the same, the petitioners preferred an appeal before the 3rd respondent-Revenue Divisional Officer, but the 3rd respondent confirmed the orders of the 4th respondent. Aggrieved thereby, the petitioners filed a revision before the 2nd respondent-Joint Collector, and along with the revision, they filed a stay application seeking stay of eviction. It is their grievance that the 2nd respondent has not passed orders either in the stay application or the revision, and the respondent authorities are taking steps to evict the petitioners. Hence, the writ petition.

3. Heard learned counsel for the petitioners and the learned Government Pleader.

4. Considering that the Revision as well as the Stay application are pending before the 2nd respondent, this writ petition can be disposed of by directing the 2nd respondent to dispose of the Stay application, or preferably the Revision itself as expeditiously as possible, preferably within a period of three months from today. Till such time the stay application or the revision is disposed of, whichever is earlier, there shall be stay of eviction of the petitioners.

5. With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
