HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 661 of 2022 O R D E R:
This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.1 in Crime No. 215 of 2021 on the file of Humayun Nagar Police Station registered for the offences punishable under Sections 307, 341 and 506 read with Section 34 I.P.C., seeking bail.

The case of prosecution is that Accused No.1 along with other accused, boring previous grudges, on 16.12.2021, at about 11.50 p.m., opposite to Mahaveer Hospital in front of JNFAC, Masab Tank, Hyderabad stabbed the victim Syed Numan with knife mercilessly on stomach, ribs, back and hand with an intention to kill him. It is alleged that the victim sustained severe injuries and was admitted to hospital with the help of local people. 3.
Learned counsel for the petitioner - Accused No.1 Sri K. Venumadhav submits that in view of the earlier disputes between petitioner and de facto-complainant's daughter, the present case is foisted against the petitioner. It is submitted that the petitioner was arrested and remanded to judicial custody on 06.01.2022 and from the last 25 days, he has been languishing in jail. He further submits that the injuries sustained by the victim are simple in nature and he was treated and discharged immediately. The learned counsel submits that already police have sought for custody of the petitioner for one day and even that is also completed and no useful purpose would be served by making the petitioner to languish in jail further. Hence, the learned
counsel requests that the case of the petitioner may be considered for grant of bail.

Learned Assistant Public Prosecutor does not dispute the fact that custody of the petitioner was obtained. He submits that so far, six witnesses were examined and Accused Nos. 3, 6, 7, and 4 were arrested and enlarged on bail.

Taking into consideration the nature of disputes between the parties and further as the petitioner is languishing in jail from 06.01.2022, and as other accused were already enlarged on bail, this Court deems it appropriate to grant bail to the petitioner also.

The Criminal Petition is therefore, allowed. Petitioner - Accused No.1 shall be enlarged on bail in connection with Crime No. 215 of 2021 on the file of Humayun Nagar Police Station on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the VI Additional Chief Metropolitan Magistrate at Hyderabad.
