HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16350 of 2016 ORDER :

Grievance of the petitioner-Association in this Writ Petition is against the Notification No.4 of 2016(Agril. Officers/Agril. Extensions Officer Grade-II, in Dept of Agril. Subordinate

Services) dt.01.05.2016.

2. By the said notification recruitment process to the posts of agricultural officers, agricultural extensions officers Grade-II in department of Agriculture in the State of Telangana is initiated.

3. The subject matter of the Writ Petition concerns recruitment to State Government Service.

4. The Supreme Court in L.Chandra Kumar v. Union of India[1] held that the jurisdiction to adjudicate all service maters concerning recruitment and employment in the state services is vested in Administrative Tribunals constituted under the Administrative Tribunals Act, 1985 and it is the court of first instance. Only after a decision is made, the Writ Petition can be maintained.

5. Therefore, this Writ Petition is not maintainable and accordingly the same is dismissed, leaving it open to the petitioner to avail appropriate remedy as available under the Administrative Tribunals Act, 1985. There shall be no order as to costs.

6. Miscellaneous petition, if any, pending in this writ petition, shall stand closed.
