THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37618 of 2016 ORDER:

Heard Sri G.Sekhar Reddy for petitioner and learned Government Pleader for respondents.

On 27-01-2016, the petitioner filed a claim petition under Rule 52 of the A.P.Co-operative Societies Rules, 1964 in E.P.No.5/ 2015-16. The 4th respondent without deciding the rights asserted by the petitioner in the claim petition dated 27-01-2016 is proceeding to auction the E.P. schedule property. Hence, the writ petition. Learned Government Pleader, on instructions, submits that the claim petition is pending as on date and the 4th respondent undertakes to dispose of the claim petition within four weeks from the date of receipt of a copy of this order, in accordance with law after affording opportunity to petitioner and thereafter proceeds, if circumstances warrant, to conduct auction.
