HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.9343 of 2013 ORDER:

The present writ petition is filed questioning the alleged interference by respondents 1 and 2 in civil dispute and forcing the petitioners to amicably settle the civil dispute between petitioners and respondents 3 and 4.

2. I have perused the affidavit and this court is of the view that the affidavit no doubt does not refer to registration of a crime against the petitioners. The learned Assistant Government Pleader does not dispute the stand in the affidavit that no crime or offence is registered against the petitioners. As the crime is not registered against petitioners, this court is of the view that respondents 1 and 2 cannot summon or much less pressurise the petitioners to settle a civil dispute between the petitioners and respondents 3 and 4.

3. The writ petition is, accordingly, disposed of, directing the respondents 1 and 2 not to interfere in the civil dispute or personal disputes between the petitioners and respondents 3 and 4. It is made clear that if a crime is registered against the petitioners or the presence of the petitioners is required, in a crime pending investigation in Pedana PS, respondents 1 and 2 can summon the petitioners, in accordance with law. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. ____________ S.V.BHATT, J Date: 21.04.2017 BSS
