Bhanu) The learned counsel for the appellant submits that the issue involved in this appeal is squarely covered by the judgment of this Court dated 17.08.2011 in AS.No.1182 of 2001.

Following the said judgment and for the reasons mentioned therein, this Appeal is also disposed of in terms of the judgment of this court in A.S.No.1182 of 2001. There shall be no order as to costs. Miscellaneous petitions, if any pending in this appeal, shall also stand dismissed.
