HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14292 of 2015 ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in trying to dispossess the petitioner from the land admeasuring Acs.10.29 guntas in Survey No.288 of Donipamula Village, Chandur Mandal, Nalgonda District, without following due process of law, as illegal and arbitrary.

It is the case of the petitioner that show-cause notice, dated 27.03.2015, issued under Rule-3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007, was received by him on 17.04.2015 and that he made a representation on 20.04.2015 seeking 30 days' time for filing reply. The grievance of the petitioner is that without considering his representation and without passing any orders thereon, the respondents are trying to evict him from the subject land. Hence, he filed the present Writ Petition.

Heard learned counsel for the petitioner.

Learned Government Pleader for Revenue (Assignments) appearing for the respondents submits that the Writ Petition is premature since the petitioner is requesting to grant time for submitting the explanation to the show cause notice and also to file the relevant documents.

In view of the above-mentioned facts and circumstances, the petitioner is permitted to submit his explanation to the show cause notice, dated 27.03.2015, which was allegedly received by him on 17.04.2015, within a period of four weeks from today and on submission of the explanation by the petitioner, the respondentauthorities may consider the same and pass appropriate orders. Till then status quo obtaining as on today shall be maintained. If the petitioner fails to file the explanation within the stipulated period of four weeks from today, it is open for the respondents to proceed further in the matter in accordance with law. With the above directions, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, W.P.M.P.No.18704 of 2015 is disposed of as infructuous. __________________________
