HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No.8541 of 2016 Order:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in F.I.R. No.409 of 2016 of L.B. Nagar Law and Order Police Station, Cyberabad, registered for the offences punishable under Sections 376, 420 and 406 IPC.
2. Heard the learned counsel appearing for the petitioner-accused No.1 and the learned Additional Public Prosecutor representing the State.
3. The allegations are that the petitioner exploited the de facto complainant in all angles in the name of love and marriage and his parents made huge demands as dowry and when the de facto complainant's parents expressed their helplessness to meet their demands, they are avoiding the marriage and cheated her and put her to harassment and also blackmailed her over phones to meet their demands by taking advantage of her weak moments.
4. Originally, the petitioner along with two others filed Crl.P. No.4933 of 2016 and by order dated 11-4-2016 this Court has granted the relief to the extent that the investigation in the crime to be completed without arrest of the petitioners 2 and 3 therein who are not the petitioners herein. The request of the petitioner herein-accused No.1 though not specifically denied but by implication, the request was not considered. The present petition is for the same relief which was already not considered by this Court on the previous occasion.
5. In that view of the matter, the present petition is not maintainable and the same is dismissed but with a direction to the police to proceed with the investigation, however, without arresting the petitioner-accused No.1 in the above crime, for a period of three weeks only from today. The petitioner-accused No.1 shall appear before the investigating agency as
and when required during the course of investigation. The miscellaneous applications, if any, pending in this criminal petition shall stand closed in consequence.
