HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.833 OF 2020 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.5598 of 2019 on the file of the V Additional Metropolitan Magistrate-cum-Additional Junior Civil Judge, Cyberabad at L.B. Nagar.

A charge sheet came to be filed against the petitioners/A-2 to A-6 for the offences punishable under Section 498-A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners/A-2 to A-6 restricts his prayer seeking dispensation of the presence of the petitioners/A-2 to A-6 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners/A-2 to A-6 is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-2 to A-6 in C.C.No.5598 of 2019 on the file of the V Additional Metropolitan Magistratecum-Additional Junior Civil Judge, Cyberabad at L.B. Nagar, is hereby dispensed with except on the dates when their presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of. Miscellaneous applications, if any, pending shall stand closed.
