HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.18862 of 2017 ORDER:
The petitioner challenges the notice Rc.B/ 392/ 2017 dated 10.05.2017, primarily on the ground that the 3rd respondent does not have jurisdiction to issue notice for the assignment in favour of the petitioner was of the year 1996. The petitioner further contends that as regards assignment in favour of the petitioner is concerned, the same cannot be reopened at the instance of the 4th respondent and therefore, prays for setting aside the notice.
Learned Assistant Government Pleader (Assignment) basing on the written instructions dated 16.06.2017contends that the scope and object of notice issued by the 3rd respondent are not properly appreciated by the petitioner. The notice proposes to look in to the grievance of the 4th respondent vis-à-vis and the assignment in favour of petitioner. As a few basic facts are required to be considered and obliged Mr. K. Srinivas requested the court to permit petitioner to file representation to work out his remedies. The statement is placed on record and without examining the other objection pointed out by the Assistant Government Pleader, the writ petition is dismissed and the reply can be filed within four weeks from today. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
