THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO C.C.No.2212 of 2015 ORDER:

This contempt case is filed alleging non implementation of the order in W.P.No.14104 of 2006, dated 11.03.2014. The said writ petition was filed challenging the demand notice for payment of an amount of Rs.2,53,228/- for Shop Nos.157 and 158 and there was dispute with regard to the number of shops taken on lease. In those circumstances, this Court disposed of the writ petition with the following directions:

"In the face of disputed facts with regard to mutation of number of shops in favour of the petitioners, the respondent-corporation is directed to issue notice to the petitioners clearly indicating the proceedings under which number of shops were allotted, payment received so far and the arrears as on today, by giving liberty to them to submit their explanation. The respondent shall issue notice within four weeks from the date of receipt of a copy of this order, giving another four weeks to the petitioners to submit their explanation and consider the said explanation submitted by the petitioners and pass appropriate orders thereon within eight weeks thereafter and take action for recovery of arrears, if any, in accordance with law."

After disposal of the writ petition on 11.03.2014, the respondent issued a notice on 31.01.2015 in compliance with the above order and the same was received by the 1st petitioner on 02.02.2015, but the petitioners did not submit any explanation. In those circumstances, another demand notice was issued on 18.09.2015. Challenging which the petitioners filed W.P.No.32560 of 2015 assailing the demand notice dated 18.09.2015. In view of the above development, it cannot be said that the order passed by this Court on 11.03.2014 was violated. Accordingly, the contempt case is dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this case shall stand closed.
