HON'BLE SRI JUSTICE T.SUNIL CHOWDARY Crl. R.C. No.2621 of 2016 JUDGMENT:
This criminal revision case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 20.09.2016 passed in Crl.M.P.No.2051 of 2015 in Cr.No.136/ 2016-17 on the file of the Special Judicial First Class Magistrate of Excise, Chittoor.
2. When the matter is taken up for hearing, learned counsel for the petitioner seeks permission of the court to withdraw the case with a liberty to file appropriate application before the Deputy Commissioner, Prohibition & Excise, Chittoor.
3. Permission granted.
4. The criminal revision case is, accordingly, dismissed as withdrawn with liberty as prayed. If the petitioner files an application for release of the property, the Deputy Commissioner is hereby directed to dispose of the same within fifteen days from the date of filing of the application.
5. Miscellaneous petitions, if any pending in this case, shall stand closed.
