SMT JUSTICE T.RAJANI CRIMINAL PETITION No.724 OF 2018 ORDER:

This Criminal Petition is filed seeking for modification of the condition imposed by the learned XIII Additional District Judge (FTC), Vijayawada, Krishna District (for short, 'the Court below'), in Crl.M.P. No.1820 of 2017 in Crime No.210 of 2017, while enlarging the petitioner on bail i.e., furnishing of two local sureties.

Learned counsel for the petitioner submits that when the local sureties were made ready, the Police went to the houses of the sureties and threatened them not to furnish the sureties. The copies of the F.D.Rs. pertaining to the local sureties are produced before this Court. Admittedly, bail was granted to the petitioner as far back as on 08.11.2017. Therefore, the fact that the petitioner, in spite of preparing the F.D.Rs of the local sureties, the petitioner could not furnish the same, would imply that the contention of the petitioner is true. Hence considering the above, this Court opines that this is a fit case for modification of the said condition. Accordingly, the Criminal Petition is allowed. The petitioner shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- with two sureties for a like sum each instead of furnishing two local sureties as ordered by the Court below. Except this modification, the rest of the impugned order shall remain intact.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
