THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY Tr.C.M.P.No.170 of 2016 ORDER:

This petition is filed under Section 24 CPC seeking to withdraw O.S.No.1 of 2015 on the file of the Court of I Additional District Judge, Ongole, Prakasam District, and transfer the same to any other Court having equivalent jurisdiction.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to dispense with the presence of the petitioner in O.S.No.1 of 2015 on each and every date of adjournment before the Court of I Additional District Judge, Ongole, Prakasam District.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the presence of the petitioner in O.S.No.1 of 2015 on the file of the Court of I Additional District Judge, Ongole, Prakasam District, is dispensed with on each and every date of adjournment. However, the petitioner shall attend before the Court of I Additional District Judge, Ongole, Prakasam District, as and when his presence is so required.

With the above observation, transfer Civil Miscellaneous Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
