THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.1375 of 2025 ORDER:

Seeking the Court to enlarge the petitioner, who is arrayed as accused in Crime No.259 of 2024 before the Maripeda Police Station, Mahabubabad District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 27.09.2024, B.Satheesh, Sub-Inspector of Police, Maripeda Police Station stated that on reliable information, a car, KWID RENAULT bearing number TS-07-HQ-3910, was transporting dry ganja. Upon investigation, 126.88 kg ganja, valued at Rs.31,72,000/-, was seized from the car, and the accused, Sodi Nageshwar Rao/petitioner, revenue department employee from Chhattisgarh, was apprehended. The petitioner had allegedly purchased the ganja at Seeleru near Bhadrachalam and was transporting it to Hyderabad to sell at a higher price.

Heard Sri K. Chandra Sekhar Reddy, learned counsel for petitioner, and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner/accused was falsely implicated and arrested and that the allegations against him are false, frivolous, and vexatious, and that he is innocent. He further submitted that the petitioner belongs to a good family, has good antecedents, and is a permanent resident of the locality, with no chance of absconding and that the petitioner undertakes to cooperate with the investigation, not to tamper with evidence or witnesses, and abide by any terms and conditions imposed by the Court. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the petitioner is a drug peddler. He further submitted that the investigation is in progress and if the petitioner is released on bail, at this stage, he may tamper

with the evidence and may threaten the witnesses. Hence, he prayed the Court to dismiss the criminal petition. 6.

Having regard to the rival submissions made and on going through the material placed on record, it is noted that the date of remand of petitioner is 27.09.2024 and there are no other similar crimes pending against the petitioner. Therefore, considering the same and keeping in mind the period of incarceration of petitioner in jail, this Court deems it fit to grant bail to the petitioner, subject to following the below conditions:

i.

The petitioner shall execute a personal bond for a sum Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the Special Judge for Trial of Cases for the Offences under Narcotic Drugs and Psychotropic Substances Act, 1985 - cum - Principal Sessions Judge, at Mahabubabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8)

weeks, for the purpose investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 482(2) of BNSS (previously known as Section 437(3) of Cr.P.C.).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
