HONOURABLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.12856 OF 2015 ORDER:
Petitioner's vehicle bearing registration No.AP 02 U 0414 is stated to have been seized by the 3rd respondent on 10.04.2015 under check report No.421374, dated 10.04.2015. Petitioner, however, seeks release of the said vehicle only by his application, dated 18.04.2015, sent to the 2nd respondent by courier. Petitioner has approached this Court seeking release of the said vehicle. Since the petitioner has already filed the requisite application, I deem it appropriate to dispose of the writ petition by directing the 2nd respondent to consider the application of the petitioner and pass appropriate orders. It is made clear that the Deputy Transport Commissioner may impose appropriate conditions, if he considers release of the vehicle to the petitioner. Keeping in view the ratio of the Division Bench judgment of this Court in SALEEM TOURS AND TRAVELS v.
JOINT TRANSPORT COMMISIONER AND SECREATARY, RTA, HYDERABAD[1], the 2nd respondent shall, accordingly, pass appropriate orders within three (3) days from the date of receipt of a copy of this order.
The Writ Petition is disposed of.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
