HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.640 of 2014 ORDER:

This petition is filed to transfer F.C.O.P.No.908 of 2014 from the file of Family Court, Visakhapatnam, and transfer the same to Family Court, Vijayawada.

2. Respondent herein filed F.C.O.P.No.908 of 2014 for dissolution of marriage before Family Court, Visakhapatnam against petitioner herein, who is the wife. According to affidavit, her marriage with respondent was performed on 26.04.2001 at Vijayawada as per Hindu rites and she joined her husband and the marriage was consummated. She stated that her husband shifted family t o Visakhapatnam for business purpose and thereafter she was harassed and necked out from the house and she came back to her parents' house and residing with her parents at Vijayawada. She stated that she lodged a complaint at Patamata Police Station on 13.07.2014 which is registered as Crime No.632 of 2014. She also stated that she filed M.C.No.266 of 2014 before Family Court, Vijayawada claiming maintenance of Rs.25,000/- per month.

She stated that respondent intentionally filed F.C.O.P.No.908 of before Family Court, Visakhapatnam, for divorce making false allegations as a counter blast to her maintenance case.

3. This Court permitted petitioner to publish the notice of respondent by way of substituted service in Andhra Jyothi Daily local edition of Visakhapatnam and petitioner filed proof of publication along with Andhra Jyothi local edition of Visakhapatnam on 16.02.2016.

4. In spite of publication respondent neither appeared in person nor through any advocate.

5. Therefore, considering the reasons stated in the affidavit filed in support of the petition, request of wife is considered and F.C.O.P.No.908 of 2014 is withdrawn from Family Court, Visakhapatnam and transferred to Family Court, Vijayawada, for disposal in accordance with law.

6. Accordingly, transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand dismissed. No costs.
