THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 42608 of 2015 ORDER:

As it is stated that the petitioner's representation dated 26.12.2015 is pending consideration before the Additional Secretary, Regional Transport Authority, Hindupur, Anantapur District, in relation to release of his seized vehicle bearing registration No. KA 06C 1339, it is not necessary for this Court to keep the present writ petition pending and adjudicate the same on merits. It is for the authority concerned to apply its mind and take appropriate action in the matter. The Writ Petition is accordingly disposed of directing the Additional Secretary, Regional Transport Authority, Hindupur, Anantapur District, the second respondent, to consider the petitioner's representation dated 26.12.2015 in accordance with law and take appropriate action in the matter.

In the event, the second respondent directs release of the subject vehicle it shall be open to the second respondent to impose such conditions as are deemed fit and proper including deposit of a reasonable amount as assessed by him and also an undertaking to the effect that the petitioner shall not alienate the vehicle or encumber it pending further enquiry, if any. This exercise shall be completed expeditiously and in any event not later than four days from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
