THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.202 OF 2017 ORDER:

Heard learned counsel for the petitioner of C.C.No.565 of 2011, pending on the file of VII Additional Judicial First Class Magistrate, Rajamahendravaram, taken cognizance for the offences punishable under Sections 493, 494, 498-A, 420, 506 r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act and also heard the learned public prosecutor, representing the 3rd respondent - State, before ordering notices to respondents 1 and 2.

Perused the averments in the petition seeking transfer of the above said case from the Court of VII Additional Judicial First Class Magistrate, Rajamahendravaram to any other court and also the order of transfer sought from the District Judge by Tr.Crl.P.No.894 of 2017, dismissed on 01.08.2017.

Even from the hearing to sit against the order there is nothing but for to say from the endeavour of the petitioner of conducting the prosecution, liberty is given by virtue of this order while disposing of to file application under section 302 r/w 24(8) proviso of the amended Cr.P.C. to file application before the learned Magistrate to conduct prosecution

personally by engaging private advocate to consider after hearing.

Accordingly and with the above directions, this Criminal Petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
