THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.36113 OF 2015 O R D E R :

The grievance of the petitioner in this writ petition is that an order dt.10.09.2015 canceling his fair price shop dealership has been passed by the 2nd respondent without giving a personal hearing.

2. A reading of the impugned order does not indicate that any personal hearing has been provided to the petitioner.

3. It is not disputed by the learned Government Pleader for Civil Supplies that a personal hearing is required to be given in enquiries dealing with cancellation of fair price shop dealership.

4. Having regard to the said fact, the impugned order dt.10.09.2015 is set aside and the 2nd respondent is directed to provide personal hearing to the petitioner and pass a fresh order in accordance with law, after considering the explanation of the petitioner to the show cause notice dt.14.04.2015 issued by the 2nd respondent.

5. The Writ Petition is allowed to the above extent. There shall be no order as to costs.

6. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
