THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.34343 OF 2015 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader appearing for the respondents 1 to 4. The prayer sought for in the writ petition is as under: " to Issue a Writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the official respondents 2 to 4 herein in not taking any action on the petitioners' complaints dated 05.08.2015, 21.09. 2015 and 06.10.2015 given to the official respondents herein as wholly illegal, arbitrary, contrary to the principals of Natural Justice and consequently direct the respondents 2 to 4 herein to take action against the unofficial respondents herein by registering a case and protect the property of the petitioners in Sy. No. 55/ a a and Sy. No. 55/ e to an extent of 24 Gts, situated at Garimilla Sivar, Mancherial Mandal, Adilabad District as per law."

The basic grievance of the petitioners is that in spite of giving complaints dated 05.08.2015, 21.09.2015 and 06.10.2015 against the unofficial respondents herein, the respondents 2 to 4 are not taking any action by registering a crime.

The 4th respondent filed a counter affidavit denying the material allegations made in the affidavit filed in support of the writ petition and contended inter alia that the petitioners have given a complaint dated 05.08.2015 alleging that they have inherited Ac .0.13 guntas of land in Sy.No.55/ a and Ac.0.11 guntas of land in Sy.No.55/ e, situated at Garimilla Sivar, Mancherial Mandal, Adilabad District and that the 5th respondent herein claiming the said land purchased by him, started demolishing the compound

wall. Therefore, the petitioners lodged the complaint. It is further stated that the complaints dated 21.09.2015 and 06.10.2015 said to have been given by the petitioners are not received by the respondents-police. As far as the complaint dated 05.08.2015 is concerned, the contents are purely civil in nature and therefore, the parties are advised to approach the competent civil Court for adjudication of their disputes.

Having regard to the above, this Court is of the opinion that no further orders are required in the writ petition and accordingly, the same is closed. No costs.
