This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A.1 to A.4, for grant of anticipatory bail in Crime No.8 of 2019 of Mattampalli Police Station, Suryapet District, registered for the offences punishable under Sections 427, 323 and 504 read with 34 of IPC and Section 3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (PoA) Amendment Act, 2015 (for short 'the Act').

Heard the learned counsel for the petitioners/A.1 to A.4, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Having argued elaborately, learned counsel for the petitioners seeks permission of this Court to withdraw the criminal petition.

As per the FIR lodged with the police in connection with the commission of offence, the de facto complainant has narrated how he was abused in the name of caste and beaten by the accused on 10.01.2019. Under these circumstances, the petitioners/A.1 to A.4 cannot be granted bail under Section 438 Cr.P.C. 5.
