M. Subba Narsamma v. The State Of Andhra Pradesh
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * WRIT PETITION No. 30646 of 2015 BETWEEN M.Subba Narsamma ... PETITIONER AND The State of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department and others ...RESPONDENTS Date of Order pronounced: 21.09.2015 THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR
1. Whether Reporters of Local newspapers Yes/No may be allowed to see the Judgments?
2. Whether the copies of judgment may be Yes/No marked to Law Reporters/Journals?
3. Whether his Lordship wish to see the Yes/No fair copy of the Judgment?
ORDER:- Heard learned counsel for the petitioner and learned assistant
government pleader for revenue.
2. Petitioner seeks mutation of her name in the revenue record on the ground that the land admeasuring Ac.5-00 in survey No.115/1 at Tallapaka Village, Rajampet Mandal, YSR Kadapa District was assigned to her and that she was issued pattadar passbook and title deed bearing No.461. Petitioner seeks mutation of her name in the revenue records by filing representation dated 17.08.2015 on the basis of pattadar passbook issued. Petitioner also relies upon order of this court in SAMP No.594 of 2012 in S.A.No.1078 of 2011 dated 18.04.2013, wherein it is stated that petitioner's assignment was accepted by the Government and it was declared that the decree, if any, passed in S.A.No.1078 of 2011 will not affect the petitioner as petitioner is not a party. Petitioner states that in spite of the said order her request for mutation has not been considered and merely because the fifth respondent has obtained an injunction order, it is not binding on the petitioner. The present writ petition is filed alleging that the request of the petitioner is not being considered.
3. Since petitioner's representation, dated 17.08.2015, is still pending with the fourth respondent without passing any orders, it is appropriate that the fourth respondent considers the request of the petitioner on the basis of the documents produced, referred to by the petitioner, and after seeing the records and the pattadar passbook already stated to have been issued to the petitioner, take appropriate further steps in terms of the representation of the petitioner expeditiously preferably within six weeks from the date of receipt of a copy of this order.
With the above direction, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
