HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2487 of 2020 ORDER:

This writ petition is filed assailing the action of the 3rd respondent in not passing orders on the stay petition filed in appeal No.G/912/2019 by the petitioner against the proceedings of the 4th respondent.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4 and Sri Kondadi Ajay Kumar, learned counsel for the 5th respondent.

Learned counsel for the 5th respondent submits that the petitioner has also filed another writ petition i.e., No.21903 of 2019 and same was disposed of by this court on 28.10.2019. In this case, it is to be seen that the petitioner had already filed WP No.21903 of 2019 and same was disposed of on 28.10.2019 directing the Revenue Divisional Officer to consider the objections filed by the 5th respondent on the maintainability of appeal on the ground of delay and if any objections filed by the 6th respondent on the same issue and the RDO shall decide the maintainability of appeal within a period of four weeks from the date of receipt of a copy of this order. If the said order is not implemented, the remedy of the petitioner is elsewhere but not by filing a fresh writ petition.

In view of the same, I do not see any reason to entertain the writ petition. However, the appellate authority is directed to

dispose of the application/appeal of the petitioner as per the orders dated 28.10.2019 in WP No.21903 of 2019. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY, J 27-02-2020 kvs
