Petitioners allege that Police authorities are interfering with their life and personal liberty and in civil disputes and Police are frequently summoning them to Police station stating that some complaint was received by them against the petitioners. 3.

As per the written instructions dated 08.02.2019 furnished by the Sub-Inspector of Police, Nampally Police Station, it appears that one person by name B.Danam filed a complaint on 29.01.2019 alleging that accused persons have created fake body of Vikas Nagar Welfare Society and floated a fake Managing Committee by producing false information and fake documents and started selling away the vacant plots. G.D. entry was made in the crime report and in the process of investigation, the Sub-Inspector called the petitioners to Police Station. The instructions would further disclose that as of now no crime is registered against the petitioners.

Even without registering a crime, Police cannot summon the petitioners frequently to come to Police Station. 5.

Therefore, both the Writ Petitions are disposed of directing the respondents-Police not to interfere with the life and liberty of the petitioners without following due process. Unless a crime is registered, petitioners need not be summoned to Police station. However, this order does not come in the way of respondents

registering a crime if a cognizable offence is made out from the report lodged by the complainant-B.Danam.

Miscellaneous Petitions pending in these Writ Petitions, if any, shall stand closed. There shall be no order as to costs. _____________________ P.NAVEEN RAO, J 11th February, 2019.
