THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2063 OF 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ of mandamus or any other appropriate writ, order or direction declaring the action of the respondents in not considering our application dt.07-12-2017 for grant of permission to use the parade grounds in GLR SVY No.699, Secunderabad Cantonment for conduct of Peace and Christmas Rally from 8th to 10th of February 2018 as highly illegal and consequently direct the respondents to grant permission immediately to enable the petitioner to make preparations for conducting peace and Christmas Rally without any delay."

When the matter is taken up, the proceedings of the respondent authorities, dated 03.01.2018, are placed on record. The said proceedings read as under:- "GRANT OF PERMISSION TO CONDUCT 'GLOBAL PEACE INITIATIVE'

AT PARADE GROUNDS SECUNDERABAD CANTT FROM 08 FEB 2018 TO 10 FEB 2018 1.

Refer LWE Dte AWAN Msg No.47000/B/Gen/LW (South) dt.07 Dec 2017.

Permission for the subject event was granted vide your letter at para 1 above, subject to conditions given by MoD ID No.53/V/US(L)/D(Lands)/2010 dt.30 Nov 2017. 3.

The subject event was not conducted by the organisation, however, Mrs.Jyoti Begal, National Coordinator, Executive Member of GUM vide their letter dt.09 Dec (copy attached) has intimated postponement of the event to fresh dates wef 08 Feb 2018 to 10 Feb 2018.

In consonance with existing policy on utilisation of defence land by various organization for religious/Political event, the grant of permission for holding the rally at Parade Ground, Secunderabad has not been recommended by the LMA. The same is endorsed by this HQ in keeping with the policy on the subject. Grant of permission to hold rally at Parade Ground Secunderabad is 'NOT RECOMMENDED'.

In view of the said rejection, the direction, as sought for in the present writ petition, cannot be granted in this writ petition. 3.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
